Florida's Condo Milestone Law and SIRS: Why Timing Comes First in Clearwater

The single most important decision in condo remodeling in Clearwater right now is not the cabinet line or the tile. It is when you start. After the 2021 Surfside collapse, Florida rewrote the rules for older condo buildings, and those rules are now working their way through almost every mid-rise and high-rise association in the city, from Island Estates and Sand Key to the buildings downtown. Get the timing right and your remodel goes in once and stays finished. Get it wrong and a brand-new kitchen can be opened right back up a few months later when the building does its own work.

Most contractors give this one sentence and move on. Because it decides so much about a Clearwater condo project, here is the plain-language version of what the law requires, why it is raising assessments, and how it should shape the timing of your unit remodel.

What the milestone inspection law actually requires

Florida law now requires a milestone structural inspection for condominium and cooperative buildings that are three stories or taller. A building generally reaches its first milestone at 30 years of age, and at 25 years if it sits within about three miles of the coast, which covers a large share of Clearwater's waterfront inventory on Island Estates, Sand Key, and Island Way. The inspection runs in phases: a visual Phase 1 by a licensed engineer or architect, and, if that turns up signs of substantial structural deterioration, a more detailed Phase 2. The association, not the individual owner, is responsible for completing it, but the findings ripple straight down to what happens inside your unit and when.

What a SIRS is, and why it is raising assessments

Alongside the milestone inspection, the law requires a Structural Integrity Reserve Study, or SIRS, for those same three-story-and-taller buildings. A SIRS is a professional study of the building's major structural and long-life components, things like the roof, load-bearing walls, floor and foundation, exterior waterproofing and paint, windows, and the plumbing and electrical systems, with a funding plan for each. The important change is that associations can no longer vote to waive or underfund reserves for the components a SIRS covers. Boards that had kept dues low for years are now required to fully fund these reserves, and the money has to come from somewhere. In practice that means higher monthly assessments, and in many Clearwater buildings a one-time special assessment to catch the reserves up.

How this reshapes the timing of your unit remodel

Here is where it touches your project. To meet the milestone and SIRS requirements, many Clearwater associations are commissioning reserve studies, passing assessments, and scheduling building-wide repairs: concrete restoration on balconies and walkways, exterior waterproofing, roof replacement, and plumbing riser or stack work. Several of those projects require access into or behind individual units. A riser replacement can mean opening the shared wet wall in your kitchen or bath. Concrete or balcony work can restrict elevator access and staging for weeks. If you finish a remodel and then your building starts one of these projects, the crews may have to cut into work you just paid for.

The smart move is to remodel around what your building has planned. If a special assessment or a scheduled repair is coming, we sequence your unit work so it lands before or after the building's project, not on top of it, and we keep finished surfaces away from the walls and risers the association will need to reach. If nothing is scheduled near your unit, there is no reason to wait. Either way, the answer starts with knowing where your building sits in its milestone and SIRS cycle.

Why a new kitchen should not be torn open six months later

Picture a full-unit remodel in a Sand Key condominium: new cabinets set on the existing wet wall, tile run to the ceiling, quartz counters templated to the millimeter. Then the association's SIRS-driven plan calls for replacing the vertical plumbing risers that run through that exact wall. Without coordination, the finished kitchen comes back apart. With coordination, we either wait for the riser work to finish first, or we design and stage the unit so the riser stays reachable and the new finishes are protected. Same building, same budget, completely different outcome, and the only variable is timing.
